Answering Your Questions About Bankruptcy
Most of my clients are filing for bankruptcy for the first time. Naturally, they have a lot of questions. The question I am asked most often is whether filing for bankruptcy will put an end to harassing phone calls from creditors. The answer is yes. After a bankruptcy petition is filed, the automatic stay immediately goes into effect which dictates that no further collection actions (including telephone calls) can be made upon the debtor. I am also frequently asked how long the bankruptcy process takes. This will depend on which type of bankruptcy you file but the average time frame for a Chapter 7 is three to six months and a Chapter 13 is anywhere from three to five years.
